Protecting the natural environment is paramount in the active cities of the Greater Toronto Area (GTA). With rapid urbanization and development, protecting green spaces and ensuring the well-being of the trees that adorn the cityscape has become crucial. The passage of tree felling protection laws brings numerous benefits to communities and the environment. By preserving urban green spaces, these laws contribute to the overall quality of life of residents. Trees are vital to mitigating climate change, improving air quality and reducing noise pollution. In addition, the regulations ensure the health and safety of trees and prevent the removal of structurally sound trees without good reason.

Tree felling laws are regulations designed to protect trees from unnecessary and indiscriminate tree felling. These laws aim to maintain ecological balance, improve cities’ aesthetics, and protect the general well-being of the community. By enforcing these laws, cities in the greater Toronto area can ensure that tree felling is done responsibly and with respect for the environment.

Tree felling ordinances differ from municipality to municipality. Municipalities such as Toronto, Mississauga, Burlington, Vaughan, Brampton, and Markham require that tree owners obtain an arborist report from a certified arborist before filing for tree felling and tree injury permits. This report must explain the condition of the tree or trees in question, information about the property, and the plan for compensating the urban green space to replace the tree that is to be removed. Only when the property owner has received the arborist’s report can he submit the application for tree felling to the forestry office in his respective municipality. Some municipalities, such as Oakville, only require an arborist report if the tree(s) are removed due to construction work. While construction is one of the most common reasons property owners request the removal of a healthy tree, this reason is not a guarantee that the Forest Service will approve the tree felling application. Often a certified arborist can work with the construction project engineer to modify the construction drawings to remove the proposed building from the healthy tree and save that tree’s life. Only in special cases where the building is non-transferrable is approval of the tree felling request required.
