The U.S. Department of Labor is closer to reclaiming the outstanding wages of FW Webb Co. workers after a federal judge ruled they are not exempt from overtime protection.
The plumbing and HVAC wholesaler’s indoor workers don’t fall under the Fair Labor Standards Act’s administrative exemption, the U.S. District Court for the District of Massachusetts said. The court also granted the agency summary judgment on a record-breaking lawsuit.
Webb falsely classified the sales representatives as exempt from overtime, kept no records of workers’ hours worked, and retaliated by trying to persuade the workers not to speak freely…
